Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your use of the Rafyo platform operated by JKRSP LTD, trading as Rafyo ("Rafyo", "we", "us"). By creating an account or using our services, you agree to these Terms. If you are accepting on behalf of a school or organisation, you represent that you have the authority to bind that entity.

2. Definitions

  • "Platform" — the Rafyo web application, APIs, and related services
  • "School" — the educational institution that has registered an account on Rafyo
  • "School Admin" — a user authorised by the School to manage its Rafyo account
  • "Parent" — a parent or guardian invited by a School to use the Platform
  • "Child Data" — personal data relating to pupils, entered by Schools or Parents

3. Accounts

3.1 School accounts

To use Rafyo, a School must register an account and verify their email address. The person who registers becomes the initial Super Admin and is responsible for managing the School's account, users, and data.

3.2 User accounts

School Admins may invite staff and Parents to create user accounts. You are responsible for keeping your login credentials confidential. You must notify us immediately if you become aware of any unauthorised use of your account.

3.3 Age requirement

You must be at least 18 years old to create an account. Children do not have accounts on Rafyo and do not interact with the Platform directly.

4. Acceptable use

You agree not to:

  • Use the Platform for any unlawful purpose
  • Attempt to gain unauthorised access to any part of the Platform
  • Upload malicious code, viruses, or harmful content
  • Interfere with the Platform's operation or other users' access
  • Use the Platform to store data unrelated to school management
  • Resell, sublicense, or redistribute access to the Platform without our written consent

5. Data and privacy

Our use of personal data is governed by our Privacy Policy. Where a School uses Rafyo to process personal data of pupils, parents, or staff, the School acts as the data controller and Rafyo acts as the data processor. The relationship is governed by our Data Processing Agreement.

Schools are responsible for ensuring they have a lawful basis to process personal data entered into Rafyo, including children's data and dietary information.

6. Intellectual property

Rafyo and its original content, features, and functionality are owned by JKRSP LTD and are protected by copyright and other intellectual property laws. Your data remains yours. We claim no ownership over any data you upload to the Platform.

7. Payments

Schools that use Rafyo's canteen ordering feature process payments through Stripe. Each School connects their own Stripe account via Stripe Connect. Rafyo does not handle, store, or have access to payment card details. Payment terms, refunds, and disputes are between the School and the Parent, facilitated by Stripe's standard terms.

8. Availability and support

We aim to keep the Platform available at all times but do not guarantee uninterrupted access. We may perform scheduled maintenance with reasonable advance notice. We provide support via email at hello@rafyo.com.

9. Limitation of liability

To the maximum extent permitted by law, Rafyo shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, however caused. Our total liability for any claim arising from these Terms shall not exceed the amount you paid to Rafyo in the 12 months preceding the claim.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

10. Termination

Either party may terminate this agreement at any time. Schools can request account deletion by contacting us. Upon termination:

  • All School data (users, children, orders, payments, audit logs) will be permanently deleted within 30 days
  • We will provide a data export upon request before deletion
  • Audit logs may be retained in anonymised form for up to 7 years for regulatory compliance

We may suspend or terminate access immediately if you breach these Terms or if continued access poses a risk to the security of the Platform or other users.

11. Changes to these Terms

We may update these Terms from time to time. We will notify registered users by email of any material changes at least 30 days before they take effect. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.

12. Governing law

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
